| DISCLAIMER

By purchasing my service (art/rig), you automatically agree to the following conditions.
Please read my Terms of service in their entirety.
I, the Artist/Rigger, am not responsible if the Client fails to read and confirm the Terms of Service. The Client is solely responsible to clarify anything unsure to the Artist.
If the Client has any questions, please contact me.

| CLIENT AGREEMENT

By commissioning me, the Artist, you agree that you have read and accepted all the terms described.
You agree to the policy of using the art for personal, non-profit purposes unless stated otherwise or depending on what you have commissioned. Clients must provide all image and rig credits to me.
Clients in violation of my Terms of Service will be added to an indefinite blacklist without warning.

| GENERAL

• You, the Client, will be expected to read my Terms of Service before commissioning and understand my general prices.
• You, the Client, will not use my artwork for AI related, NFTS, and cryptocurrency.
• You may not claim my artwork and/or rigs as your own creation.
• You may not edit, modify, trace, or alter my work in anyway unless given consent.
• You, the Client, may use the Artwork for personal use including but not limited to: phone/device wallpapers, personal website/profile displays (icons+banners), avatars.
• You, the Client, may use Vtuber Models and Rigs for monetized content including but not limited to: streaming, recording, video production.
• Do not rush the Artist for the completion of a commission if you, the Client, did not state a deadline in the beginning.
• I, the Artist, have the right to decline your commission request for any reason.
• I, the Artist, reserve the right to post your finished commission in my gallery for any reason, unless an NDA or privacy agreement has been made.
• I, the Artist, reserve the right to refund you the full amount paid if I no longer wish to work on your project for any reason.

| COMMISSIONING

Ordering• You are expected to fill out the Commissioning Ordering form on my VGen or Website.
• After ordering you will receive a reply from me discussing the details of the commission (if needed depending on the service) as well as me confirming the slot for the commission.
• If your character is extremely detailed, I have the right to charge a free to include these details. This fee will be stated and discussed before the transaction takes place, and you hold the right to make changes to your request before completion.
• Please when submitting a request make your wording concise with minimal abbreviation so that I have a clear understanding of what you want, I will contact you if unsure on anything.
• Before making any transaction (ie sending funds) you are required to wait for a reply from me, so that we may discuss details.
• Once everything is confirmed, I will send you an invoice and confirm payment before I start your order.Payment• Payment is done after I send an invoice through VGen or Paypal.
• All prices are listed in USD.
• Payment plans can be discussed, but only available for commissions above $200.Private Commissions• Private commissions cannot be shown on my stream or social medias.
• and/or Final product cannot be showcased on my social medias or public portfolios within 30 days after project completion.
• and/or Final product cannot be showcased on my social medias or public portfolios at any time (must be discussed).Monetized Content• This commission fee is required if the intended use of the commission is using the artwork for profitable digital activities such as but not limited to: monetized video creation, streaming, recording.
• Monetized content fee is not required for Vtuber Models or Vtuber Rigging.Commercial Merchandising• This commission fee is required if the intended use of the commission is using the artwork for mass distribution and/or profitable activities such as but not limited to: printing the artwork for sale, using the artwork for merchandise/sale.Rushed Order Fee• Rush order fee is required if a Clients deadline is within 1 week.Other Fees• Complex designs may increase the commission cost due to increased workload.
• Additional fees for design work such as but not limited to: character, mascot, no references provided.

| REFUNDS & CANCELLATION

• Refunds and cancellations can only be done in certain circumstances, such as: I, the Artist, cancelling the commission, work has not started within half a year after initial payment.
• If a payment plan has been agreed upon and the commission has been started after the first deposit is made, I will not refund the deposit.
• The Client must never request a payment charge back after a work has been finished, doing so will be considered violating my Terms of Service and will lead to indefinite blacklisting.

| REVISIONS & FEEDBACK

• I will send a Work in Progress image after either 100% of the payment is completed or a deposit has been made on the payment plan.
• All Work in Progress will come in the form of a .png file or .mov attachment depending on the type of work.
• The responsibility is on you as the client to ensure your order contains the details you want.
• You as the client are free to request a WIP at any given time, but I will provide updates as I work.
• Each time a WIP is sent to the client, I ask for any necessary feedback to be provided.
• Changes can be made at the sketch stage, but once on coloring/rendering a fee may incur for any large changes.
• After completion of order only minor changes can be made, please discuss with me.Final Product• The Client must respect that my artistic style cannot be altered and I will not replicate another artists style or work.
• Credit to me, the Artist, is required when posting the commission.
• There may be slight differences between samples in my portfolio and the commission you receive.

| USAGE RIGHTS

Prohibition of AI Use• You, The Client, are strictly prohibited from uploading, inputting, training, or otherwise using the commissioned work, in whole or in part, in any artificial intelligence (AI) system, dataset, generator, or related technology. This includes; creating videos/animations of the commissioned work, using commissioned work to generator other images, using commissioned work to train any artificial intelligence (AI).Copyright• I, the Artist, retain all copyright over my work and am allowed to use the image as a sample for sale or self promotion. A public commission can be posted on my social medias, with proper credit linking back to you for ownership of the design.
• I, the Artist, have the rights to stream my work progress on twitch and/or social medias.
• The Client is Prohibited to resell work that I have made without my consent.
